Terms of Service
OVERVIEW
Welcome to DELLUMIA. The terms “we,” “us,” and “our” refer to DELLUMIA, operated by Soltek LLC. DELLUMIA operates this website and online store, including the related content, features, tools, products, and services (collectively, the “Services”). Our store is powered by Shopify.
These Terms of Service (“Terms”), together with the policies referenced below, explain your rights and responsibilities when accessing our website or purchasing from DELLUMIA. Please read them carefully, including the provisions concerning warranties and limitations of liability.
By accessing or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, please do not use the Services. Nothing in these Terms limits rights that cannot lawfully be waived.
SECTION 1 - ACCESS AND ACCOUNT
By using the Services, you represent that you are at least the age of majority in your state or place of residence or that you have the legally required permission to use the Services. You are responsible for ensuring that purchases made through your account or devices are authorized.
When placing an order, you may be asked for contact, billing, payment, and shipping information. You agree to provide accurate, complete, and current information and to update it when necessary.
You are responsible for keeping your account credentials confidential and for activities under your account, except where applicable law provides otherwise. Please contact us promptly if you suspect unauthorized access. You may not sell, transfer, or assign your account without our prior written consent.
SECTION 2 - OUR PRODUCTS, IMAGES AND MATERIALS
We make reasonable efforts to describe and present our jewelry accurately. Product details, materials, finishes, stones, sizes, and other specifications are described on the relevant product pages and in our Materials & Details information.
Product photographs, lifestyle images, digital renderings, and promotional visuals are intended to illustrate our jewelry. Some images may be digitally edited, enhanced, or generated for illustrative purposes. Colors, reflections, apparent stone size, proportions, and finish may appear different depending on lighting, screen settings, camera perspective, and image enlargement. Images are not necessarily shown at actual size. These explanations do not change the material characteristics or specifications expressly stated for a product.
Measurements, stone weights, and other specifications identified as approximate may have minor production tolerances. Accessories, props, and styling items shown in images are not included unless expressly stated in the product listing.
Jewelry finishes and plated surfaces can experience natural wear over time. Changes in appearance may depend on frequency of wear, skin chemistry, friction, moisture, cleaning products, perfumes, cosmetics, chlorine, saltwater, and the care a piece receives. References to everyday wear or occasional water contact do not mean a product is permanently waterproof, immune to discoloration, or guaranteed never to tarnish. Please review our Jewelry Care guidance and the description of the individual product.
Where a product is described as “hypoallergenic,” that term refers to the intent to reduce the likelihood of skin irritation; it does not mean that every person will be free from an allergic or sensitivity reaction. Individual sensitivities vary. If you have a known metal allergy, contact us about the specific product materials before ordering, and discontinue use if irritation occurs. Any product-specific claims remain subject to applicable consumer protection law.
We may update product descriptions, pricing, availability, or designs, and discontinue products, subject to applicable law and obligations relating to orders already accepted. We may reasonably limit quantities where necessary to prevent fraud, misuse, or unauthorized resale.
SECTION 3 - ORDERS
Submitting an order is an offer to purchase. An automated order acknowledgment does not necessarily constitute acceptance. We may accept an order by confirming it or beginning fulfillment. We may decline or cancel orders for legitimate reasons, including inaccurate information, unavailability, suspected fraud, or pricing errors, subject to applicable law.
If we cancel an order after payment has been collected, we will refund the amount paid for the canceled items in accordance with applicable law. Please review your order carefully before submitting; cancellation or modification may not be possible once processing has begun.
Returns and exchanges are governed by our published Refund Policy, together with any rights provided by applicable law. Purchases are intended for personal or household use and not for unauthorized commercial resale.
SECTION 4 - PRICES, PROMOTIONS AND BILLING
Prices are displayed in U.S. dollars unless expressly indicated otherwise. Prices, discounts, and promotions may change before an order is placed. The amount payable will be shown at checkout and in the applicable order confirmation. Applicable taxes and any other charges required by law will be disclosed at checkout.
DELLUMIA currently advertises free standard shipping for U.S. orders, subject to the terms of the offer displayed at checkout. Promotional offers, automatic discounts, gifts with purchase, and spending thresholds may have separate eligibility conditions and exclusions. Where a particular promotion has express terms, those terms govern that promotion, subject to applicable law.
You agree to provide valid payment details and confirm that you are authorized to use the selected payment method. We may use Shopify and authorized third-party payment processors to process transactions. You authorize the charge for the total amount displayed and accepted at checkout.
If a material pricing or promotional error is identified, we will contact you where reasonably practicable and provide any refund required by law if an order is canceled.
SECTION 5 - SHIPPING AND DELIVERY
We ship to eligible U.S. delivery addresses according to our published shipping information and the shipping options available at checkout. Processing and delivery timelines are estimates unless expressly guaranteed. Delays may occur due to carrier operations, weather, address problems, customs where applicable, or events beyond our reasonable control.
If an order is delayed, lost, damaged, or incorrectly delivered, please contact us so we can investigate and assist. The allocation of risk of loss, delivery obligations, refunds, and available remedies is governed by applicable law; nothing in these Terms automatically transfers all risk to you merely because a parcel has been given to a carrier.
You are responsible for providing a complete and accurate delivery address. We will handle order-related delivery issues in accordance with our shipping information and applicable law.
SECTION 6 - INTELLECTUAL PROPERTY
The Services and their original content, including DELLUMIA branding, logos, design elements, product text, original images, graphics, videos, and page layouts, are owned by DELLUMIA or used with permission from the relevant rights holders and are protected by applicable intellectual property laws. Third-party names, images, trademarks, and content remain the property of their respective owners.
You may use the Services for personal, lawful, non-commercial purposes. Except as permitted by law or with prior written authorization, you may not reproduce, redistribute, commercially exploit, or create derivative works from protected site content. No right or license is granted except as expressly stated.
SECTION 7 - OPTIONAL TOOLS AND THIRD-PARTY SERVICES
The Services may include optional tools, applications, or functions supplied by third parties. Your use of such offerings may be subject to their respective terms and privacy practices.
To the extent permitted by law, third-party tools not operated or controlled by DELLUMIA are made available without a separate guarantee from us regarding their uninterrupted availability or performance. Nothing in this section limits responsibilities or rights that applicable law does not permit us to exclude.
We may introduce or discontinue features or tools from time to time.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain links to third-party websites or content. We do not control those websites and are not responsible for their independent content, security practices, or policies, except where applicable law provides otherwise.
Please review the terms and privacy practices of third-party websites before interacting with them or completing transactions outside DELLUMIA.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
DELLUMIA is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with DELLUMIA. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and DELLUMIA, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with DELLUMIA.
SECTION 10 - PRIVACY POLICY
Personal information processed through our Services is subject to our Privacy Policy. Certain information may also be processed by Shopify in accordance with its Privacy Policy.
Because Shopify hosts our store, it and our service providers may process information required to operate the Services, process orders, support customers, and provide store functionality. Our Privacy Policy explains how information is handled and what rights may be available to you.
SECTION 11 - CUSTOMER FEEDBACK AND REVIEWS
If you submit reviews, comments, photographs, suggestions, or other content (“Feedback”), you represent that you have the rights needed to submit it and that it is truthful and does not infringe the rights of others.
You grant DELLUMIA a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and adapt your Feedback for operating and promoting the Services, subject to applicable law and our Privacy Policy. You retain ownership of content you own. We may moderate or remove Feedback that violates these Terms or applicable law.
You must not submit fabricated reviews, falsely represent your experience, or omit required disclosures of incentives or material relationships. We do not require positive reviews as a condition of receiving customer support.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
From time to time, the Services may contain typographical mistakes or inaccuracies relating to pricing, descriptions, offers, shipping, or inventory. We may correct such errors and update information. If a material error affects an order you have already submitted, we will address the order and any refund owed in accordance with applicable law.
Nothing in this section permits material changes to completed transactions in violation of applicable consumer protection requirements.
SECTION 13 - PROHIBITED USES
You agree not to use the Services for any unlawful, fraudulent, abusive, deceptive, or harmful purpose, including violating another person’s rights, transmitting malicious code, attempting unauthorized access, scraping in violation of applicable law or these Terms, impersonating another person, sending unsolicited spam, or interfering with store security or operations.
You may not reproduce or exploit protected site content for unauthorized commercial purposes or collect personal information in violation of applicable law. We may restrict access where reasonably necessary to protect our Services, customers, or legal rights.
SECTION 14 - AGENTS AND AUTOMATED ACCESS
14.1 This section applies to autonomous or semi-autonomous software (“Agents”) that access or interact with the Services on behalf of a person or organization.
14.2 Agents may access or interact with the Services only in compliance with these Terms, applicable law, and any technical restrictions we lawfully maintain. We may limit or block automated access where reasonably necessary.
14.3 An Agent must not misrepresent its identity, circumvent CAPTCHAs or access controls, conceal prohibited automation, or interfere with the integrity or security of the Services.
14.4 Where technically applicable and required by our access rules, Agents must identify themselves in HTTP/HTTPS user-agent requests in the format “Agent/[agent name]” and respond truthfully to questions about whether an interaction is automated.
SECTION 15 - TERMINATION
We may suspend or terminate access to the Services when necessary to address violations of these Terms, suspected fraud, security concerns, or legal requirements. Termination does not affect rights or obligations that arose before termination, including obligations regarding accepted orders, refunds, or product warranties.
Provisions that reasonably need to survive termination, including intellectual property, warranties, limitations of liability, indemnification, and dispute-related provisions, will continue to apply to the extent permitted by law.
SECTION 16 - PRODUCT WARRANTIES AND SERVICE DISCLAIMERS
DELLUMIA offers a written jewelry warranty as described in our published Warranty Policy. The applicable warranty specifies its coverage, duration, exclusions, and claim procedures. Nothing in these Terms reduces the coverage expressly promised in that policy or any non-waivable statutory consumer rights.
Normal wear, accidental damage, improper storage, chemical exposure, and other circumstances may affect a jewelry finish; whether a particular claim is covered is determined under the published warranty terms and applicable law. Statements about water resistance, hypoallergenic properties, plating longevity, or appearance should be understood in their stated product-specific context and are not guarantees of absolute or permanent performance unless expressly represented as such.
While we make reasonable efforts to keep our website accurate and available, the website and non-product digital features are provided on an “as available” basis. To the maximum extent permitted by law, we do not guarantee that access to the website or optional digital tools will be uninterrupted or error-free.
We do not disclaim implied warranties where doing so is prohibited by law. In particular, nothing in these Terms excludes implied warranties that cannot lawfully be disclaimed when a written consumer product warranty is provided.
SECTION 17 - LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, DELLUMIA and its service providers shall not be liable for indirect, incidental, special, or consequential losses arising from use of the website or Services where such liability can lawfully be excluded.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, personal injury caused by a product defect where liability cannot lawfully be excluded, non-waivable consumer protection rights, remedies under an applicable written or implied warranty, or any other liability that cannot legally be limited.
This section does not deprive you of a refund, repair, replacement, or other remedy to which you are entitled under applicable law or our written policies.
SECTION 18 - INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify DELLUMIA and its affiliates, personnel, and service providers against third-party claims and reasonable costs arising directly from your unlawful misuse of the Services, your infringement of another party’s rights, or your material breach of these Terms.
This provision does not apply to claims resulting from DELLUMIA’s own wrongdoing or to ordinary, good-faith consumer use of the Services, and it does not limit non-waivable legal rights. We will provide reasonable notice of any claim for which indemnification is requested and allow reasonable cooperation in its defense.
SECTION 19 - SEVERABILITY
If a provision of these Terms is held invalid, unlawful, or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in effect to the extent permitted by applicable law.
SECTION 20 - WAIVER; ENTIRE AGREEMENT
A failure to enforce a right or provision under these Terms does not constitute a waiver of that right or provision.
These Terms, together with the policies expressly incorporated or referenced herein, constitute the agreement concerning use of the Services, subject to product-specific representations, accepted order terms, and non-waivable consumer rights. Nothing in this section cancels binding written warranty promises or rights created under applicable law.
SECTION 21 - ASSIGNMENT
You may not transfer obligations under these Terms without our prior written consent, except where prohibited by law. DELLUMIA may transfer its rights or obligations in connection with a legitimate business transfer, reorganization, or sale, provided that applicable customer rights, accepted orders, and warranty obligations remain protected as required by law.
SECTION 22 - GOVERNING LAW AND DISPUTES
Subject to mandatory consumer protection laws and any applicable limits on choice-of-law provisions, these Terms are intended to be governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.
Any dispute shall be brought before a court with lawful jurisdiction and venue. Nothing in this section requires a consumer to give up a venue, forum, or other legal protection that cannot lawfully be waived.
SECTION 23 - HEADINGS
Headings are included for convenience only and do not change the meaning of these Terms.
SECTION 24 - CHANGES TO TERMS OF SERVICE
We may revise these Terms from time to time by publishing an updated version on our website. Changes will apply prospectively from the effective date stated or otherwise permitted by applicable law. Material changes will be communicated where legally required.
Changes to these Terms do not retroactively remove rights arising from completed purchases, accepted orders, or warranties already provided, except where the law permits such changes.
